YOUR ACCOUNT OBLIGATIONS
In consideration of your use of the web portal, you agree to:
- Provide true, accurate, current and complete information about yourself as prompted by the registration form (the “registration information”); and
- Maintain and promptly update the registration information to keep it true, accurate, current and complete.
You are responsible for maintaining the confidentiality of your password and registration and are fully responsible for all activities that occur under password and registration. You agree to immediately notify us of any unauthorized use of your password or account or any other breach of security. The web portal considers this registration information private. The information is kept on a secure server to protect it from outside parties. We use the information only for the limited purposes of processing course fee, for statistical purposes to improve our web portal and services to you, to administer our web portal, and to notify you of course fee or special offers that may be of interest to you.
If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete. We may suspend or terminate your registration and refuse any and all current and future use of the web portal.
ACCOUNT REGISTRATION
In order to access certain features of the site and application, and to enroll for courses, you must register to create an account and become a member. You may register to join the services directly via the site or application or as described in this section. A teacher is also registered and an account created once selected by MYLEARN LERN for providing services through the site or application.
You can also register to join by logging into your account with certain third-party social networking sites (including but not limited to Facebook; each such account, a (Third Party Account), via our sites or application, as described below. As part of the functionality of the site, application and services, you may link your MYLEARN account with third party accounts, by either:
(i) Providing your third party account login information to MYLEARN through the sites, services or application;
(ii) Allowing MYLEARN to access your third party account, as permitted under the applicable terms and conditions that govern your use of each third party account. You represent that you are entitled to disclose your third party account login information to MYLEARN and /or grant MYLEARN access to your third party account (including, but not limiting to, for use for the purposes described herein), without breach by you of any of the terms and conditions that govern your use of the applicable third party account and without obligating MYLEARN to pay any fees or making MYLEARN subject to any usage limitations imposed by such third-party service providers. By granting MYLEARN access to any third party accounts, you understand that MYLEARN will access, make available and store (if applicable) any content that you have provided to and stored in your third-party account so that it is available on and through the site, services and application via your MYLEARN account and MYLEARN account profile page. Unless otherwise specified in these terms, all social networking sites content if any will be considered to be member content for all purposes of these terms. Depending on the third-party accounts you choose and subject to the privacy settings that you have set in such third party accounts, personally identifiable information that you post to your third party account will be available on and through your MYLEARN account on the site, services and application. Please note that if a third party account or associated service becomes unavailable or MYLEARN access to such third party account is terminated by the third party service provider, then social networking sites content will no longer be available on and through the site, services & application. You have the ability to disable the connection between your MYLEARN account and your third party accounts, at any time, by accessing the settings section of the site and application. Please note that your relationship with the third party service providers associated with your third party accounts is governed solely by your agreement(s) with such third party service providers. MYLEARN makes no effort to review any social networking sites content for any purpose, including but not limited to for accuracy, legality or non-infringement and MYLEARN is not responsible for any social networking sites content.
Your MYLEARN account and your MYLEARN account profile page will be created for your use of the site and application based upon the personal information you provide to us or that we obtain via social networking sites as described above. You may not have more than one active MYLEARN account. You agree to provide accurate, current and complete information during the registration process and to update such information to keep it accurate, current and complete. MYLEARN reserves the right to suspend or terminate your MYLEARN account and your access to the sites, application and services if you create more than one active MYLEARN account, of if any information provided during the registration process or thereafter proves to be inaccurate, fraudulent, not current, incomplete, or otherwise in violation of these terms.
You are responsible for safeguarding your password. You agree that you will not disclose your password to any third party and that you will take sole responsibility for any activities or actions under your MYLEARN account, whether or not you have authorized such activities or actions. You will immediately notify MYLEARN for any unauthorized use of your MYLEARN account.
COURSE FEE ACCEPTANCE POLICY
Your receipt of an electronic or other form of course fee confirmation does not signify our acceptance of your course services, nor does it constitute confirmation of our offer to promote. The web portal reserves the right at any time after receipt of your course fee to accept or decline your course fee for any reason/s. The web portal reserves the right at any time after receipt of your course fee services, without prior notice to you. We may require additional verification or information before accepting any course fee.
YOUR CONDUCT
You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the web portal, use of the web portal, or access to the web portal. You agree not to access the web portal by any means other than through the interface that is provided by us for use in accessing the web portal.
OUR RIGHTS
The web portal may terminate your access, or suspend your access to all or part of the site, without notice, for any conduct that we, in our sole discretion, believe is in violation of any applicable law or is harmful to the interests of another user, a third-party provider, merchant, sponsor, licensor, service provider, or us.
The web portal may elect to electronically monitor areas of the site and may disclose any content, records, or electronic communication of any kind
- To satisfy any law, regulation, or government request;
- If such disclosure is necessary or appropriate to operate the site;
- To protect our rights or property or the rights of the users, our directors, employees, representatives, sponsors, third party providers or licensors. We are not responsible for screening, policing, editing, or monitoring such content.
TYPOGRAPHICAL ERRORS
In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, the web portal shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. The web portal shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled the web portal shall immediately issue a credit to your credit card account in the amount of the incorrect price.
APPLICABLE LAW
As far as legally possible this agreement, its terms and conditions and the use of this web portal shall be governed by the laws in existence from time to time in India. Any claim related to the web portal, the services provided through the web portal or the Indian law shall govern the content.
TERMINATION
This agreement is effective until terminated by either party. If you no longer agree to be bound by this agreement, you must cease your use of the service, including any access thereto. Your use of the service is at your sole risk. If you are dissatisfied with the services, its content, or any of the terms, conditions, and policies of this agreement, you sole and exclusive legal remedy is to discontinue using the services.
These terms are effective even if this agreement is terminated by either party. Subject to applicable law, we reserve the right to suspend or deny, in our sole discretion, your access to all or any portion of the web portal with or without notice.
You agree that any termination of your access to the web portal may be effected without prior notice, and acknowledge and agree that we may immediately deactivate or delete your registration and all related information and files under your registration and bar any further access to such files or the web portal.
If you breach any provision of this agreement, then you may no longer use the service. Further, you agree that we shall not be liable to you or any third-party for any termination of your access to the web portal.
GENERAL INFORMATION
These terms of use constitute the entire agreement between the web portal and you and govern the use of the web portal. You may also be subject to additional terms and conditions that may apply when you use affiliate services, third-party content or third-party software. Our failure to exercise or enforce any right or provision of the terms of use shall not constitute a waiver of such right or provision. If any provision of the terms of use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the terms of use remain in full force and effect.
